How to Make Your Codicil Legal

⚠️ Your Codicil is Not Yet Legal

You have downloaded your document, but it is not valid until you follow these steps in accordance with South African law (Wills Act 7 of 1953).

Step 1: Prepare

Print the document. Initial the bottom of every page in pen. Do not sign yet.

Step 2: Find Witnesses

You need 2 competent witnesses who are:

NOT beneficiaries in your Will or this Codicil
Over 14 years old
Of sound mind (competent to testify in court)
Not your spouse

Choosing the wrong witnesses will make your entire codicil invalid.

Step 3: The Signing Ceremony

This is a single event. All three of you must be in the same room from start to finish.

You sign first in front of both witnesses.
Witnesses sign immediately after, in front of you and each other.
Witnesses must print their name, address, and occupation.

Leaving the room between signatures will invalidate the document.

Step 4: Secure It

Paperclip (do not staple) the codicil to your original Will. Store them together in a safe place and tell your Executor where they are.
